My father was a dentist in So Cal whose passion was real estate, obtaining his agent license, then brokers license. He bought and sold apartments, homes, and commercial buildings, and developed 10-20 unit commercial buildings. This eventually allowing him to have FIRE at 55 years of age. With my father at 90 years old now, the parents still live off the cash flow from their rental units.

There is usually no intention of messing up the seller, they have every intention of seeing the sale through via an investor flipper. Now, I believe assigners should be as up front with the seller as possible and tell them that there may be a slight chance the sale wont go thru and in that case, reward the seller with keeping the earnest money or a little more..But trashing the whole method of assigning because you had a bad experience isnt an objective opinion

If you got a grand-slam deal, say, a property with an ARV of $100,000 for $20,000, only needing cosmetic repairs of $10,000, and you sell the contract for a fee of $15,000, even though there is plenty enough spread for the buyer (he’d be getting it for $30,000, plus $10,000 rehab, meaning his profit would be $50K+), he might think you are a chump for trying to make a $15,000 wholesale fee. Or he might not, but you at least are taking that risk.

Rehabbers are very limited in their volume potential. The best might juggle 3 projects at a time. That may turn out to be about 12 deals a year. Any landlord with that many properties is also going to need to turn to either a professional property management company or stick to turnkey real estate investments. Yet, for wholesalers, doing 12 deals a month isn’t unheard of. Even if you do 2, you are doing 2x what the house flippers are. Sometimes your profits may not be too much different, and that’s without all the extra time and risk involved.

Hi Jay, I bought my personal house in July 2013 as an owner occupant and put 20 percent down,but I had multiple lenders that would do 5 percent down and that was on a jumbo mortgage. At the time I had 7 or 8 rentals as well. I choose not to do a 5% down, because the PMI made the loan much more expensive than 20% down. I definitively had the option to do it and had quotes with multiple properties. You have to make sure you are buying as an owner occupant and you will be living in the home. I am also a Realtor and have seen many investors buy a personal residence with less than 20% down when they owned rentals.

How does the process work with finding buyer B or am I suppose to search for buyer B and if so where do I search? Also if possible I would love to get the templates for the contract, and cover letter, and closing documents e-mailed to me, please!
I use a technique that has been proving to be much more effective than direct mail. I have a software platform that sends ringless voicemail directly to the lists that I would typically send a piece of mail. It runs on complete auto pilot for the investor. No dealing with printing, postage, and waiting for the mail to be sent out. It’s only .50¢ per drop and this includes the data/lists. I have partnered with Fidelity National Title to work individually with each investor in determining what data would be most effective. Fidelity has the cleanest and most accurate data in the USA. They update weekly and can provide any list you’d need. Once you work out what data you want to use, the drops can be made any day of he week that you’d like to receive phone calls. The calls come in immedietely after sending the drops. The amount of people who hear your message is significantly higher than mail. 96% of people who receive a vm will actually listen to it. Now, you may say, I do not need cash for this.  I can simply Option the property for a wholesale price and then sell it to a rehabber or end user.  You are absolutely correct, but getting an owner to accept a wholesale price is rare.  You will make 100 wholesale offers to owners before one is accepted.  Where you will have much better luck is buying foreclosures from banks.

Yet after over 100+ such deals over the last 20 years I have yet to have a lender exercise this clause.

In some ways, assigning a contract wasn’t all that different from acting as a realtor, because I would be wearing a lot of the same hats and doing some of the same things a realtor would do for their client. The difference was – I had a signed purchase agreement between myself and the seller, which gave me an equitable interest in the property. This contract was like a paper asset, which I could sell to a third-party and get paid an “assignment fee” without ever owning the property myself.
Now, the idea of assigning contracts (aka – “wholesaling”) always sounds great on paper – but let me tell you, I struggled for YEARS to understand the mechanics of how this process really works.

Your article says if they aren’t a licensed agent / broker they can’t broker the deal, putting seller and buyer together. How then do they make their money? Is it in the contract? Still isn’t this considered broker activities? Ok, Being day 4 of my Wholesale Adventure, this article and the comments scare the shit out of me. I agree with, not being dishonest, and being up front in the expectations with the seller, so they know how the process works, but even then, the seller has to come through as promised. Mark I do heating & air conditioning as a licensed hobby (insured n bonded)- It’s a long story (recession, partnership dissolved, near retirement, etc) do u think if I invest in an HVAC replacement, tuneups, other repairs, etc n put buyer together with seller that would not make me a Realtor but a wholeseller. “If you build it, they will come” (Field of Dreams, 1989). A few months ago, a good friend of mine, and part-time investor/landlord used this quote to drive a point home to me. We were talking about wholesaling, and I said that I need to have a buyers list in order to get started and make some money. He told me that investors are EVERYWHERE, in a dark secret society, looking for reasons to come out into the light. The irresistible deal draws them. He told me to put together deals that can’t be ignored, and I’d have cash buyers contacting me day and night. I’d put out some ads for buyers and written letters to Listsource buyer leads. I never got one response. Then I got my first deal under contract about a month ago. At first I figured the ARV too low, and I got no calls or responses of any kind from any of my property ads. I went back to the seller and renegotiated a lower price and then put the property back out there. Suddenly, my phone started going crazy. Just in the last week, I have had 6 investors come through and look at the place. I have had 2 other wholesalers offer to JV with me in the same time frame. I have three more appointments to show the place this week. I am fairly certain that a buyer will snatch this up before the end of this month, based on what I’ve been experiencing. I have now built a buyers list that I can use going forward. It all started building the irresistible deal though. Price to sell, and try to over calculate repair costs if you don’t know for sure. If a property needs extensive work, get several estimates from contractors you trust. Don’t forget to factor in the expenses you’ll incur while you’re holding the property, along with closing costs. Justin Pierce, a real estate investor who flips properties in the Washington, D.C., suburbs, says he starts by estimating the sale price of a fixed-up home. Once he comes up with that number, he subtracts buying and selling costs (typically 10% to 15%), a profit margin of 15% to 20%, and the cost of repairs. With those numbers in hand, he can determine how much he will offer.
In an assignment, you will simply write (in the spot where you write the buyer’s name) “and/or assigns” after your name. This means that you, and/or someone you assign the contract to, will buy the property. Assignments are typically not allowed when buying foreclosures, but most homeowners will not care. However, it’s important that you are upfront with the seller about your intentions. Next, you’ll need to sign an “assignment contract” with your cash buyer which officially assigns them the contract.

Under what is known as the doctrine of equitable conversion, this enables a buyer to become the equitable owner of the property while the seller maintains bare legal title to the property under the terms of the agreement.
If you have the ability and those others that were sold were in similar condition and size and location, I don’t see why not to do it that way.

I gave him a 5,000 EMD check. I am about to settle on the property and on the settlement documents I see a $5,000.00 charge called an “Assignment Fee” I was unaware of any additional charges such as this… I am already in the deal for $5,000.00 and will lose the EMD if I pull out. Is his a normal practice to slip in a charge like this?

Why would a seller choose one over the other? You are correct. Wholesaler tries to buy for $52k and signs a contract with seller. Then assigns that contract to an investor for $8k (so they sign an assignment contract with the new buyer agreeing to pay $60k with the difference being paid to the wholesaler as an assignment fee). The wholesaler’s assignment fee will be paid at closing by the title company out of the proceeds from the sale.
